La banque centrale du Congo RDC a mis en place un nouveau dispositif règlementaire sur le change au Congo RDC, entré en vigueur le 25 septembre 2014, qui consacre la primauté du franc congolais sur les devises étrangères. Cette règlementation des changes remplace celle de 2003 et apporte certains amendements mais surtout des innovations importantes.
Il y a 3 points économico-financier, social et commercial qui ont été revus:
La réglementation est répartie en 10 chapitres, traitant respectivement :
des dispositions générales,
des biens,
des services,
des revenus,
des capitaux et opérations financières,
des dispositions applicables aux titulaires des droits miniers et aux sociétés pétrolières,
du marché des changes,
des comptes libellés en monnaies étrangères et des comptes résidents en monnaies nationales,
des intermédiaires agréés,
des modalités pratiques d’élaboration et de transmission des statistiques à la banque centrale, et
des dispositions finales.
Les apports de la nouvelle réglementation: la primauté de la monnaie locale pour les paiements des ménages, la redéfinition du rôle du services des douanes, les formulaires réglementant l’importation et l’exportation des biens mais surtout des produits miniers et pétroliers sont plus encadrés, les services et les revenus, capitaux et opérations financières ont été adaptés au sixième manuel de la balance des paiements du FMI. La réglementation s’adapte aussi aux nouvelles exigences technique en prenant en compte les établissements électroniques émettant de la monnaie électronique.
